Hi there...

Just found this community. I've been using IJ as a backup for bit now...

I know this is shameless self-promotion, and if it's not ok I'll take this down. But I thought I'd mention that as a 07refugee myself I've started my own blogging service, it goes by the name of Pirate Journal...
I should explain, since I and the hosting service service, are both UK based, the rules are a touch different over here. Plus, it's not based on Brad's code, so I don't have to use his license.

What that amounts to is censorship free blogging.
I mean, even Insane Journal is subject to federal law, and if you read the TOS it's very similar to LJ's [actually, so's mine, but with a few critical changes].

Anyway, I thought I'd mention it, please drop by and check us out. I'm still shaking the bugs out of the code at the moment, [we've only been 'live' a week.] but everything works and I'd appreciate feedback on things like the TOS [or the articles of piracy as they're called!] and other details...

Registration isn't quite up and running, but *ahem* there is a free backdoor open at present, as long as people don't abuse it.

I keep hoping for a journal site service that will use rules like these... basically, don't commit crimes, and don't cause us weird hassles. (I've talked to them. What they mean by "be nice" is "do not bring the wrath of cops or lawyers or weird geeks who write bizarre manifestos upon us." They don't care how polite or not their users are online.)

I have a problem with the standard phrasing in most services' TOS:
unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, libelous, invasive to another's privacy..., hateful, or racially, ethnically or otherwise objectionable;

WTF is "otherwise objectionable?" Are you aware that's the clause LJ is using to justify kicking people out without refunds right now?

I'd much rather something said, "unlawful, including but not limited to harassing, tortious, defamatory, or libelous."

Forbid crimes, and let people otherwise be as "objectionable" as they want. ISPs and webhosts should not be threatening to ban people for saying "stupid people suck"--which would fit under the current TOS.
That's a pretty fair set of rules, and good deal shorter and clearer.

I'm not exactly sure if it would hold water if put to a legal test...but something like that would serve pretty well as the plain English translation of the longer TOS.

You do have a point about the "Objectionable" phrase, I missed that during the cut & paste process. With your permission, i shall use your phraseology since as you say, it makes a bit more sense.

The hosting service I'm using has an TOS that amounts to: "we don't care what you do with it, just so long as it's not illegal or breaks our servers. And if it is illegal, you're on your own mate!"
