JLA #42 Cover Pencils

As I understand it there is currently an editorial ban on the use of the New Gods. So does this mean Dr. Impossible and whoever he's teaming up with on this cover (one of them resembles Steppenwolf) are not New Gods? I didn't read the Dr. Impossible arc of JLA, so I don't really know what his story is.

Didn't they play together in a Birds of Prey arc? I may have the wrong character here, but I thought she was one of the ones who found Barda mighty intimidating.
