JLA #42 Cover Pencils

As I understand it there is currently an editorial ban on the use of the New Gods. So does this mean Dr. Impossible and whoever he's teaming up with on this cover (one of them resembles Steppenwolf) are not New Gods? I didn't read the Dr. Impossible arc of JLA, so I don't really know what his story is.

And died with the rest of the New Gods, I'm sure. Wait, no, looks like he was killed by being a member of the Teen Titans Trigon, but Little Barda would've bit it with the rest of the New Gods.
