I live in Northern California. And personally, I wouldn't call a riverbank with nobody around 'public'. If it were in the middle of a city, that would be different - it would fall under 'drunk and disorderly' - but this is the middle of nowhere! She might as well be in her living room for all the turmoil she'd cause by being drunk out here! I mean, it's just her and the cops, and what evidence do they have that she's drunk? Don't they have to give you a breathalyzer test or something before determining that?
