Heh, I like this twitter troll, who can't spell DMCA or tu quoque or dirty hands doctrine a la Alcatel USA, Inc. v. DGI Techs., Inc., 166 F.3d 772, 794 (5th Cir. 1999): "It is old hat that a court called upon to do equity should always consider whether the petitioning party has acted ... with unclean hands."
Obviously she or he is no attorney at all, but oh I do hope she or he works for Marvel in any capacity.
Tuck this twitter feed away just in case he or she (or they) work(s) in any capacity for someone who comes looking for injunctive relief against IJ or any of the photo hosting sites mentioned. It's an obvious thing for discovery.
This is especially important in light of some of the tweets that indicate some postings which in and of themselves appear to be unfair (not, as it happens, that I think that really matters with respect to fair use analysis of the whole community, or the images embedded in practically every posting).
In particular, the mocking of stuff that is pretty clearly fair use would totally undo his or her employer's ability to use a line of thought along that in Books Incorporated v. Kinko’s Graphics Corporation (758 F. Supp. 1522 (S.D.N.Y. 1991)) wherein the copyright abuse = unclean hands line of defense was tested on whether the copyright holder (or its agents) had ever advocated for an expansion of copyright into areas protected by fair use. Which is exactly what this twitter troll has done. Shazam!
PS: Dear troll, you might want to look up "contributory infringement" and ponder the effects of you tweeting out URLs of unauthorized works in which exclusive copyright is held by an assortment of publishers.
