Well, the article said that this character dates back to 1954. So as long as the rights haven't somehow migrated to Image or Mcfarlane since then, I don't see how he could support a claim like that.

I call horsecrap on this, Hulk's one of their legacy characters. They might de-power him for a long time, but at the end of the script Banner is Hulk again.
