I'm pretty certain Spider-Woman always has them going to some extent; she wears a perfume to help counteract them. In Secrets and Lies she tells Cap she's stressed so she'll be pumping out pheromones, and he says he'll cope and he does.
The times I've seen her use them deliberately were against one of the Wrecking Crew, (early New Avengers) who she stopped dead in the middle of a rampage, and to break up a fight between Tony Stark and Wolverine (Execute Program). Now, Jessica is also a very attractive woman, and all three mentioned are single men not noted for their celibacy (less sure about the Wrecker guy), but when she goes all-out on the Wrecker, and explains the pheromones afterwards, Luke Cage and Spider-Man talk afterwards about what a relief it was to find out, Peter adding "I love my wife."
So it would seem that even with her going full-out, the pheromones aren't neccesarily strong enough to make someone sleep with Jessica if they have a good reason not to. And someone warned, (admittedly someone with a lot of willpower) is minimally affected by her stress-pheromones.
SO I'm not sure how rape-y the pheromones can be - it will depend on how Daken's been shown using them, but it's possible Marvel can squeak by on "Pheromones just make someone find you attractive, rather than overcome their will." Buuut that does rely on them having considered the implications, which, well, Marvel haven't done a fab job with that recently.
