Other iterations of that individual cannot be tried for the same crimes. This is a concept that exists in many cultures, a legal term called "double jeopardy". If I review an individual and find them guilty of murder, I cannot then review the same individual and find them guilty of the same murder, again. There must be sufficient distinction for the trial to be meaningful.
The only truly fair way to do it is by random lottery. You consider this an unlucky individual punished for a crime, but that perspective is looking at the smallest possible picture. Looking at the big picture, you would see that this is one lucky timeline that is helped.
