Mod Post: Rule addendum
Dear Members,

Due to this being a new community, your lovely moderators are working out the kinks in the rules and regulations. We would like to advise you of a new rule. ABSOLUTELY NO PEDOPHILIA will be tolerated.

Clarification: Participants (yes even fictional ones) MUST be of the legal age of consent in your state, province, country of origin. Your mods have decided to simplify this and say absolutely NO ONE UNDER 16 if you laws say 18 or 21, you are responsible for seeing your work upholds this standard, since we have no way of knowing where you live.

I don't want to come across as a hard case people. I am not but once again, KIDDIE PORN WILL NOT BE TOLERATED!!!

Once again we apologize for the inconvience and promise that changes like this will not be a common occurance.

But fiction with sex scenes with minors is not illegal. In the US, in Belgium, or in Finland (I'm a Finn living in Belgium and I believe Insanejournal is US-based?), so there's no chance of you guys getting into trouble. The stuff gets published in dead-tree format, for goodness' sake. I'm not saying you shouldn't use your discretion in weeding out clearly pro-child abuse pornographic material, but I'm not too happy about the idea of not being able to write and post, say, Ginny/Lee fumbling virgin sex in Half-Blood Prince, if I felt like it. There's a slight difference between portraying sex between two teens (something that happens all the time) and imagining twelve-year-olds abused by adults. And on that note, what about fiction that deals realistically with the delicate subject of child abuse, from a non-pornographic point of view and in a manner that could never be called encouraging? How about mention of teen sex without graphic description?

Of course, it's your comm and your rules at your discretion, but I thought I'd let you know how I feel about it.

How about hobbits? They're considered underage until they're 33 (though some marry before that). (This would potentially make my recent Rosie/Marigold smut fic out of bounds, and also every pre- or during-Quest Merry/Pippin.)

You are welcome to share your concerns. We encourage it. I encourage it. There will be no lj retardness here, and while I will not go so far as to say this place is a democracy (mods do have the final say) it is a republic, we do want to know what you feel.

Saying that I have to say that none of the sceniros you brought up in your post really fit under this rule, and would be allowed. And I have to say that your comment about the Hobbits I hope was in jest. Because, ummmm Middle Earth is not real, and therefore is not a place were you can conceivably live. This means that the shires 33 year old age of consent rule should therefore have no bearing on you or the members of this community. :)

	I threw the hobbit thing in just to confuse the matter even more, because it does feel confusing to me! It all comes down to how the author chooses to interpret hobbit ageing, anyway. In deference to my co-mod, we have discussed this. The scenarios you mentioned are of interest topic wise.

This is what we have agreed upon:
Groping between similar age teens is acceptable.
Sex between teens 15 to 17 only is acceptable, but not actively encouraged.
Sex between an adult and anyone below 16 is strictly forbidden.

Sex is defined as the touching of genitals to another person, penetration or other wise.

Sexual Abuse is allowed to be mentioned, the trauma of which is allowed to be explored. The actual act, however, is not to be written in any graphic detail so as to elicit a sexual response.

As for the Hobbits. If they are old enough to have sex, then we can over look the age thing.

:D Thank you, all that sounds very sensible and proper!

With the hobbits, I think a lot of it comes down to how the author interprets their ageing. Is it the same years of childhood as a human has and a long period of irresponsible young adulthood (tweenage) leading up to 33, or do they age more slowly? If the latter, we could just count about 1,5 hobbit years for every 1 human, thus making 33 ->21... But that's pretty impossible to make mod rules about. :D If they're adult in the interpretation, there we go, right?
