The problem with common sense is that it's neither common nor always sense. Breaking down the law into it's component pieces for consistency and morality in debate provides well-balanced analysis that brings this country towards A More Perfect Union. It's not the process that is the problem. It's the people undertaking it.
Whether or not killing you would be murder has to do with the circumstances of the crime. It may very well be manslaughter (invol./vol.) or justifiable homicide. The punishment of your aforementioned offense may not meet with what you'd hope would be the sentence of the crime. But premeditated murder is still premeditated murder, however you slice it.
