i_assist Birthday Greetings

She wasn't going to say anything, but Max felt like Babs had gotten awfully maternal since letting that pipsqueak come live with her. Not that Jake was a bad kid, he was kinda cool for a ten year old, but all the maternalness that Babs couldn't use on Jake during the school day seemed to be being transfered to her.
Well, this once, at least. But Max was taking it as a sign of things to come. Forget that fact that what Babs was telling her was actually rather legit, it was still awfully maternal. If she heard 'be careful' one more time she was going to scream. Max got out of the library as fast as was possible once three o'clock rolled around, without seeming rude. Saying she didn't want to keep Alfred waiting wasn't really a lie, or it wouldn't be once five thirty rolled around.
It was her birthday, yet she was still sticking around after school in the computer labs which had become something of a hangout for her as she voluntarily worked on extra credit assignments for her computer science class. Today it was just because Max didn't want to go back for the manor for just a few hours. She was planning on spending the night at Jesse's and was going over by five thirty, so that she'd arrive in time for dinner. Alfred knew, and that's why he was picking her up then instead of directly after school. Babs knew as well, which was why she'd gotten the maternal lecture. Definitely not something Max wanted to experience again.
She worked on some programing for the few hours and at a quarter after five she went and grabbed her stuff from her locked before going out to meet Alfred.
Luckily Alfred didn't have the same words of warning Babs had, just a simple cheery 'happy birthday', a card, and news that there would be a cake waiting for her tomorrow, information which Max appreciated greatly. She was in a good mood by the time she was clambering out of the car in front of Jesse's complex, and by the time she'd reached his door and was grabbing for her keys, it was even better. Jesse was well aware it was Max's birthday. How could he not be? She'd been talking about it forever. It was written on every calander, and had somehow gotten entered into his little computer. He had a sneaking suspicion that Max had done it, but there was no real way to prove it. And he could just ask her without sounding like he didn't want it there.
He'd gotten ready for it.
A fresh suit. Supplied by the closet. A birthday cake. Supplied by the fridge. Wine. Supplied by the ... same unknown place that had supplied the dinner cart. Long ago Jesse'd stopped trying to figure these things out.
He had a little jewelry box that contained a pair of matching silver bracelets in it, which he had knowingly gone out and gotten for her. But that was about the only thing that was pure him.
Really. It was a little annoying that he wasn't able to set up special times for them. The City was always a step ahead. And no way around it.
He stood waiting for her as the door opened.

Max finally found her keys (she really was going to have to clean out her backpack one day. The candywrappers at the bottom did no one any good) and stuck the right one in the right lock and turned. Yanking her bag back up onto her shoulder, she pushed open the door.
"JES... oh." Yelling out when she got into the apartment had become second nature, but she stopped when she saw him standing right there and looking quite nice in a suit.
Max grinned widely, dropping her bag to the ground. "Hi."

"Happy birthday." He said in return. A smile on his face just as big as the one on hers.
Jesse didn't move. He wanted her to have a bit of a chance to look around.
"There's dinner too, but I thought maybe you'd like to go out for dinner this time. The City might be disappointed, but what the hell, right? Oh. Kojak has something for you too."
On cue, the dog trotted out with a wrapped gift.

"Out?" She did want to, except it made her wish that her shopping trip the other day had been productive instead of weird and tinged with the crazy. It could have been worse, but it was still bad enough being a magnet for insane people.
That was forgotten for a moment though when Kojack came int. Max crouched down and scratched him behind his ears before looking at his wrapped gift. It was kind of bone shaped, which was sweet in a doggish sort of way. She unrapped it and discovered she was right, except it was a squishy type of bone and pink, matching both her hair and his collar. "Thanks, boy." Max rubbed him again and let him lick her face.
When she stood back up she wiped her face a bit and turned back to Jesse. "I want to go out, but, uh..." she looked down at her uniform. "Wnat me to go see if I've left anything here I can change into? You look too dashing for me to just go out like this."

"I'll just sit in here and you can go get ready. Take your time. Have a shower if you like. This is your night, completely."

"Alright, I'll be right back." She'd try to be, at least. She'd never been a long shower taker, but sometimes it could take her awhile to get dressed. The fancier the outfit was the longer it took her. Mostly because it was way too complicated.
Max stepped around Kojak and hurried off to the back of the bedroom in the back of the apartment. She made a beeline for the closet, thinking that she'd probably left skirt here at least once, or some nicer pants. There was an extra blue and grey uniform, identical to the one she was wearing, and a few pairs of her jeans folded on the ground. A couple of blouses too, but nothing to wear them with.
It took her a moment to spot the white dress nestled in the back of the closet. Now that was definitely appropriate for going out to dinner. Better than the uniform by far, which she got out of in a hurry.
After a quick shower Max got dressed and looked back in the closet once more for shoes. She was provided with sandles that slipped on easily and gave her some height, which was always nice.
When she walked back out to meet Jesse her hair was still a bit damp, but combed out. Otherwise, she was completely ready. "Know where we're going?" She did a little turn in the dress just so he could see it.

He went to the dinner cart and took the lid off, and then set the platter on the floor. Kojak should have some part in the festivities even if he couldn't go with them, right?
He got up from the couch and took her hand, twirling her once. "Very nice, very very nice."
The gift for her was tucked away in his coat. "Ready? Need anything?"

"I'm good." She grabbed her smaller purse of of her backpack. It didn't match, but so what. Her keys and wallet went in, while the mini computer went out. She figured it wouldn't be needed tonight.
Max took Jesse's arm --because wasn't that how it usually happened-- and nodded to the door. "Shall we? I like Italian. And Mexican. And Chinese. Though, Mexican in a white dress is probably not a good idea." She grinned up at him.

He smiled at her, gave Kojak one last glance and headed out.
As soon as they got downstairs and outside, Jesse stopped. They really didn't have to go far at all for the food that she'd mentioned.
Right there, where there hadn't been before, was a Italian resturaunt. A Chinese place was at the end of the block, and when Jesse turned around to look at his building, there he spotted a Mexican place on the corner.
"Well." He said, not wanting to even think about the physics involved in all this. "Take your pick. Apparently we're in walking distance."

The physics of it were probably kind of interesting... to Max at least. But then, she was a geek anyway when you got down to it.
She wasn't thinking about physics though, when she noted all of the resturaunts around them. She was just trying to decide where she wanted to eat. It wasn't that hard of a decision in the end. "Italian. Looks nice." She pointed to the small place nestled in between buildings.
"So what'd you do today?" Max asked as they walked. Having not spent that weekend at the apartment she hadn't seen him in awhile.

"Not a lot. Got ready for tonight, mostly. Went out and did a little shopping. Played with Kojak. He's far too happy with his own room. It's remarkably clean, too."
He made sure the street was clear and walked Max across to the Italian place. They got right in and got a table. Jesse whispered to the waitress when Max wasn't looking that it was her birthday and if they had anything special (and embarassing) they could do for her, that would be great.
"What about you? How's school been going?"
Jesse sat and ordered a bottle of wine for them, then parused the menu for a moment before setting it aside.

"It's school," she said, poking her tongue out at him. It was the same answer she always gave at first whenever he asked her this question. It gave her a chance to stall and think of something interesting. "It's going alright, I'm just waiting for it to end. I don't graduate until late June." Which meant she'd be in school about three weeks longer than she would've been back in Gotham, but she wasn't complaining too much so long as she got out. She liked school and all, but everyone needed a break.
"I've been fixing computers and stuff too," Max added. "Started with some lawyer guy's a few weeks ago and it's been building from there. Plus 'family stuff' so, s'why I haven't been around much."

"Gonna do the big graduation walk thing?" He had no idea what this was actually called. He also didn't know what normal school lengths were. "What kind of family stuff, nothing bad, I hope."
Jesse pointed at the menu when the waitress came back. He didn't really know how to pronounce what he wanted, and didn't want to interrupt Max anyway. He waved away the question for something else to drink. Water and wine was enough.

Max told the waitress what she wanted as well before handing over the menu.
"Of course I'm gonna do the walking thing," she continued with a grin. "And you're gonna be there, I hope. It's like... the big day." Call her crazy, but she was looking forward to standing around with Terry and her other friends in oversized gowns and caps. It was all part of the experience.
For once when he asked about family stuff, Max didn't have anything bad to report. Kind of a nice feeling. "Nope. It's just, one night we had a family dinner so I had to go to that, and also Babs has this new little kid living with her so I've been doing 'babysitting' while she works. He stays in his room a lot though, so it's no big."

A smile crept over his face. "Before the waitress comes back with our food, I want to give you this." Jesse took out the box and slid it across the table to her. "I know that it's supposed to wait, or something, but I really just want to give it to you now. Happy birthday, baby girl."

"That's okay." She was grinning. They both knew she wasn't the most patient person on the world anyway.
Max took the box and opened it without preamble, looking up at Jesse once or twice as she did. When she finally did see what was in the box though her eyes were pleasantly riveted to the sight.
She took the silver bracelets out of the box carefully and finally slipped them on. Once they adorned her wrists Max eyed the tiny etchings in the silver. "Jesse, you get me the best presents. Thank you." She'd have kissed him if she could have reached over the table. As it was she settled for flashing him a brilliant grin.

It made him smile that she liked it so much. Jesse sat back in the chair and just grinned at her, not saying anything until the food was brought.

Max raised her glass and touched it against his. "And here I thought sixteen was good. Eighteen's starting off nicely," she said with a laugh.
She'd been waiting for it for so long after all, it had to go well. It'd been a good day so far, she was determined it'd keep on that course.
"I guess after five months you'd have to know what I like pretty well," she said, still smiling at him. She picked up her fork after a moment and started twisting her pasta onto it.

Jesse couldn't wait until the really embarassing thing happened. He almost couldn't eat because of the silent giddy glee welling up inside of him. He managed, though, to keep up appearances.

"Yeah, Babs gave me certificate to this electronics store that sort of makes me salivate everytime I walk past it." Max blushed and tried to look innocent of being a dork, though it probably wasn't working.
"She gave me this sort of weird motherly lecture too, but I liked the certificate more. I think they're gonna do more of an offical birthday thing at the manor tomorrow," she said and then laughed. "Other than that, I got homework."

"What are you going to get at the electronics store?" Jesse raised an eyebrow. "I'm sure you've already got some idea, don't you?"
Their food was brought to them, quickly. Jesse wondered if maybe this was the best service he'd ever had, or if maybe, he was not paying attention at all to time. The latter seemed more probable.

Max grinned, looking as impish as she could manage. "I need some surveilance stuff, I think. Don't even ask, it's just something I want." She had access (plenty of it) to Babs' house and her clock tower, but that wasn't the same as having her own things.
She continued to grin happily. "Just that really. Maybe a new tool pack since I'm fixing up computers now, but that's it," Max said. "It's sorta nice to keep busy."

Jesse decided to not ask about the surveilance whatnot. He'd stay out of it. After her telling him what they had set up, he'd decided he'd just much rather ignore the whole thing.
More wine was poured for them and he tried a bite of his meal. It was quite good, actually. Nothing like he'd expected from an establishment that had quite literally just sprung up.

"Well this guy, Matt Murdock-- he's a lawyer, he put up this flyer a few weeks ago 'cause he needed his internet connections set up and stuff. He's blind, so I guess he couldn't really do it himself," Max explained rather quickly, as she tended to when she was enthusiastic. "And since I got paid for it, and 'cause I'm taking all these computer classes at school, I figured I might as well make it a thing."
She put another forkfull of pasta into her mouth, chewed, and then had a sip of wine. She was no wine expert, but in her opinion it was rather good. She hadn't ordered a vintage and neither had Jesse, so she assumed that the waiters had chosen what would go best with the meal. They'd chosen well.

His dish was disappearing quickly. Obviously he'd been hungrier than he'd thought he was. Probably because he had been not eating and running around all day.
"So you got a sort of afterschool job. Which you can make into more of a full time thing when you graduate. A lot of people probably wish they could have the same luck."

"Oh, yeah, Jack..." the grin left her face slightly. Jack was not exactly a smile worthy matter and now she remembered something else that Jesse probably needed to know. Well, two things really.
"I met one of his friends in the mall the other day. Like... the one time I go shopping and I meet this freaking crazy guy who says Jack sent him to find me. He didn't hurt me or anything. Just kinda pulled my hair." Max pointed to the white dress she was wearing. "I was looking for this."
She gave him a bit of an appologetic look. "I'm trying not to go out alone too much, but sometimes you can't help it, y'know? This guy's still out there, but... did you hear about Arkham?"

"No. I didn't hear anything about it. The only thing I know about it is that it appeared during that big to-do a while back. That it's an asylum. What happened?"

But, back to business. Max took her wine glass again, preparing herself for the stuff she was about to launch into. "Jack basically... eh, killed everyone sane at Arkham. All the doctors, nurses, and security. I think he was trying to take the place over, but the police baracaded him after a few days and finally they managaed to get him out. But not after he'd burned all the bodies in the courtyard. Long story short, he's in jail now. And there's gonna be a trial. Babs told me everything. She thinks that they're gonna want me to testify."

He ate while he listened to the rest, careful to not take his eyes off her, so she could know that he was, in fact, listening.
But when she got to a certain point, he had to put the fork down.
"That's insane." Jesse muttered. "He killed everybody?" And then set them on fire? That was just going too far. "Are you going to do it, testify?"

Max bit her lip at his last question, as it wasn't something she'd completely given a lot of though to yet.
"Maybe?" She shrugged and looked back down at her plate. "I don't know. There's something about it... I know it's the right thing to do, right? If it puts him in jail, but... see, back home, he never stayed in jail. Like, even with trials and security and police. He never stays in jail."
Max frowned and started winding pasta around her fork again. "So, picture this, 'kay? I testify and then he gets put in jail, right? But then he gets out. What happens then? He comes... well. He comes after me. I don't like that scenario," she said rather firmly. "'specially since he's already sending people out after me."

"But either way, Max, he's looking for you. Either way he's going to do it. Like you said, he's sending people out after you. So maybe if you testify, this gives us a little more time to figure things out. Discover how to keep him there, in jail, or keep you out of his line of sight."
Jesse shrugged a bit. "I think you should do it. Especially if it gets him more time. At least it'll make people aware of what he's capable of. Maybe you could save some other girl's life by getting up there and telling your story. Even if, by some chance, he gets off completely, then at least people know, right? They know, and they can do something about it."
He was slipping right back into his role as a preacher. Giving out the good advice. Helping with a hard question. He didn't even notice that it was happening. Mostly because it'd been so long since he'd done it, and also because it was so natural, had become such a part of him.
His eyes were soft as he looked at her.

I think even Babs is going to testify because he tried to do something to her in a parking lot one day. She didn't really tell me everything that happened."
Max glanced up at Jesse now that the hard stuff was out. "People were aware of him at home too, or at least back when he was alive and active. He's just... well, you know. You met him. Though, admittedly you had it a lot easier than Batman's ever had up against him. I'm being selfish kinda. I don't want to give him any more reason to try and kill me, but I know that I should testify."

He reached across the table and took her hand. "Here is not home, and that's something that we've both got to come to terms with. Here maybe people will be more helpful. Maybe they'll be better at keeping the guy in check. You'll never know unless you give them a chance. Not all people in the world are evil, baby girl. And you, are not by any means, being selfish. You want to stay safe. Why shouldn't you? I want you to stay safe as well. Jack already has all he needs to want to kill you. He saw you. He knows about you. You being up on the stand isn't going to change any of that. Is it?"
He squeezed her hand gently. "I'll be there with you."

There was a beat before she squeezed his hand back. It was comforting, though it didn't erase all the fear instantly. "I'm glad. 'Cause, I don't want to sit there looking at him alone."
She could see it now. She'd be sitting on the stand with whoever the lawyer was and he'd be questioning, and Jack would be sitting in the defense chair mocking her and cooing at her as he seemed to like to do. He loved her name, he loved her hair... it all made her want to shudder.
Not really very happy thoughts for her birthday. Max bit her lip again and tried to smile over at him. "Hey, 'least I reached eighteen before I died, right? I mean... eighteen years is a long time."

Just then, as if on cue, a group of waiters and waitresses came out of nowhere, clapping, singing, and holding a small birthday cake in their hands.
They headed right at Max.

Max's cheeks turned the same color as her hair, their previous conversation almost forgotten. She looked from the staff approaching them back to Jesse and then back to the staff again.
"Um... Jesse?" She eyed the cake and the lit candles and put a hand over her face in embaressement. It was the good kind though, even though she sort of wanted to sink under the table. "You told them it was my birthday?" she muttered from behind her hand.

"Hell yes I did, baby girl." He laughed over the singing. He started to clap his hands along with them, though he didn't try to join in their singing.
She looked mortified, and it was so much fun. He'd never gotten to do this to somebody before, and while he understood there would likely be revenge somewhere down the line, it was very enjoyable right now.
"Happy birthday, darlin!" He laughed some more.
The crowd of singers finished their song and were gone, leaving him and her alone, with a cake and him still snickering. He couldn't help it. He tried to stop, he really did. It was all just too priceless. Jesse wished he'd had a camera to catch that look on her face.

Max kept her hand right where it was, even though that cake was chocolate and looked really good. But her face was still pink and she could feel it burning.
"I didn't even do this to you," she mumbled, uncovering her eyes slightly. "I don't think I've had this since I was like... seven."
He was so completely enjoying this, Max could tell. The grin on his face was obvious enough. She grinned just a little, but didn't let him see it. "I should blow out the candles, shouldn't I?" Before the wax melted onto her chocolate.

So she did so, which really just caused her more embaressment because she only got about ten of them snuffed out at first blow. Max looked up at Jesse, found herself blushing again and then blew out the rest. If it was this hard at eighteen how bad was it going to be a twenty?
"Well now I'm gonna have to get you back," She said, reaching over to pull one of the candles out of the cake and suck off the chocolate. She grabbed the cake cutter next. "You want?"

The waiter passed and Jesse asked for the bill. Just so they could have that part over and done with. It was handed over and when he looked at it, the thing was much less than he'd expected.
Jesse shook his head and slid money in. Money that he'd known he would have, despite his lack of a job. Maybe he was getting too used to the City providing.
"Take your time, Max. I have a feeling they won't kick us out any time soon."

"Is it chocolate? The one at home." she asked as she licked the icing off another candle. She had the knife and everything, but it was just so much fun to act like she was ten years younger.
Finally when Max'd done eight of the candles she cut into the section she'd cleared of them and placed a rather large slice on her plate. "I can probably 'take care of it', but I won't be able to move later." Not that that mattered, and she made no qualms about digging into this slice and then a next.
"I don't mind going back to the apartment now." Max finished off her third piece, thoroughly cleaning to chocolate off her fork. There was about a third of the cake left, if that.

He watched in amazement with a smile on his face as she really did start taking care of the whole cake on her own.
"Yes." He said in reply to her chocolate question.
"You ... finish off that tiny bit and we'll go back." His smile grew. "Sate your lusts a little bit with the chocolate."
Okay, so it was a tease, but it was also hard to not know what she was looking forward to. The thing that they'd talked about so many months ago.

"I'm not gonna be able to move." She mock glared at him before taking the last slice. There was definitely room in her stomach for it, and she wasn't sick of the taste of chocolate yet, so she started on it, if more slowly than the last few.
"And chocolate doesn't sate anything, it just tastes really good." Two could play at the teasing game. Max licked the chocolate from her lips slowly before going back to finish the slice and didn't feel guilty about it at all. Jesse'd started it.
Her fork clanged softly against her plate a few moments later. "Done. You're gonna have to help me with the one at home."

He had to avert his gaze, otherwise they'd be in trouble before they even got out of the place. She was being evil, and he was sure she was well aware of it.
Think of the cake. he couldn't be sure if it was him, or Genesis telling him this. Sometimes their voices sounded the same.
Cake was a good thing to think of, though. Because thinking of it made him wonder if he'd covered it, and that brought him to wondering if the dog was at it right now.
He chuckled to himself thinking of the small dog attacking the large cake.

"So're we ready?" Max looked at him expectantly, perfectly ready to push away from the table. She'd seen him place the money down for the bill, so it wasn't as if they had to wait for that.
She grinned at him, completely unknowing that he was focused on cake. "Let's go celebrate."

"After you." But he stood and got her chair for her. And then offered her his arm. As always.
He poked at her a little, trying to see if she was too full to walk on her own, and maybe to tickle her a bit.

She took his arm, though that didn't stop her from promptly losing her balance when Jesse poked her. Being ticklish and not used to wearing heels did not make a good combination, Max found out.
She tottered and laughed, as he'd hit one of her more ticklish spots, and gripped him tighter. "You're not funny, and if I fall out of these shoes or out of this dress I'm blaming you. Walking is hard enough."
He made her shriek, and for that Max wanted to glare at him. And would once she was done with the laughter. She was extremely ticklish and he knew that. It wasn't fair.
She put a hand to her side to block him even though it made for awkward walking and left her other side wide open. "It won't be funny once I fall and you have to spend all night nursing me back to health."
