A few people have pointed out that copyright is settled through civil action and isn't considered a criminal offense, so even if the Attorney General doesn't like it, there's not much he can do about it except notify the various copyright holders. Some lobbies (notably the RIAA's) have been pushing to get infringement criminalized, but there's some pretty stiff opposition to the bill.
I think a lot of the posters have a point-- Six Apart's launch into shady practice may be counting on fandom's general fear of the law, since most fans don't think they can fight the power... though in reality it's pretty damn easy, as Something Awful has been proving for a while now. Maybe they could lend us Leonard J Crabs for a while?
