I agree that precedents seem to be possible here. (Of course, I'm no IP lawyer, don't even play one on TV. Aren't all lawyers talking to the press going to emphasize that their client's case could bring An End To Civilization As We Know It?)
I'm mainly struck by the -- as you say, snivelly? -- if I read you right; what looks a lot like a BNF doing a Fandom Flounce here about SVA being so MEEN she can't write, is nearly in tears about Harry. (I seriously do *not* get this. If she's that identified with him that someone else saying his name HarryHarryVoldemortHarry is like being violated.... ewww. No. TMI.)
With scores of books about HP on the market, I'm just not seeing the infringement from one more, especially one that sorts and lists the myriad bits of info so usefully. Good grief, I have concordances on the Bible like this, and no one implies that they desecrate the Bible by quoting it. Far from it, churches recommend them to folks who are seriously into the Bible. (Mine are b/c I seriously study religion, lol, and don't *want* to try to memorize the Bible.)
I'll be interested in hearing what the lawyers bring forth. They exaggerate too, but not as much, and are at least exaggerating about real facts, such the legal system defines them.
