i didn't say that you did say it. i used to word "imply." you did say To me, it's essentially pre-meditated because if you *didn't* want to kill anyone, you wouldn't risk driving, which basically means "if you *did* want to kill someone, you would risk driving." hence, not "said" but certainly implied.
that is still NOT pre-mediated murder because someone wishing to commit pre-mediated murder rationally considers the options that will increase the chances of successfully killing someone or at least increase the chances of getting away with it. first of all, if you are in an ALTERED STATE OF MIND, which is what being drunk is, then you aren't making a rational decision. second of all, unless you can prove that someone while sober had the intention of killing someone and decided that being drunk and running into a person with their vehicle was going to be their method of choice, then you cannot assume that someone intended to kill someone instead of intended to get home without causing an accident.
