Steve nodded, a little confused on what Stark was doing. He said he would handle this, and here Cap was standing to approach the Judge. It was the exact opposite of what Steve had assumed. He was thinking Tony would be able to talk them out of this, and have them home before supper. Maybe there was a method to the madness. Giving him a nervous glance, he walked to the front and sat by the judge.
The judge motioned for the prosecution to go first. In a few seconds, Steve was looking at the thin and weak looking man who seemed to be excited to grill Captain America.
"Mr. Rogers, were you aware that Mr. Lensherr was a criminal?"
"Yes, Sir."
"Did you know less than 2 months ago, he attacked New York?"
"I had been told, Yes."
"So with these facts, did you think it was wish to go to Washington in an effort to free his friend?"
"Charles Xavier is a friend to Erik Lensherr, but their morals are completely different." Steve said this with a solid face. The look alone would show he believed this idea.
"So you were going to help Mr. Xavier?"
"Yes."
"Then why did you allow his Brotherhood to kill innocent men? You could have stopped them at any time."
"You are right. I could have stopped them, but then I would have been killed. I made sure Xavier's Students didn't use lethal force. Without me, you wouldn't have had that luxury."
"But you had to have known that Magneto's students were only there to get Xavier. They didn't care if they killed humans. What does that say about them?"
"Human Criminals kill humans. What does it say about them?"
With this, the Lawyer looked a little embarrassed but continued. "Human Criminals do not control metal, Captain Rogers."
"Human Criminals have police to control them. People like the Brotherhood have the Avengers."
Another silent moment before a question. "The issue is simple, Captain Rogers. You could have helped the American people at the site. They were following orders, and you allowed them to be killed. Most of those men probably worshiped you. Imagine their betrayal as you hit them with your trade mark shield."
The Avengers lawyer objected, but Steve motioned it was alright. He looked at the lawyer, responding.
"Mr. Fitzgerald, you aren't wrong. Those men might have looked up to me, and been confused when I went for them. Many of the soldiers died, at both locations, because of what the Brotherhood did. If you are trying to get my response about what I did? I will regret it every day for the rest of my life. Never before have I seen such carnage and ruthless behavior from a person as I did in the Brotherhood. I'm not against going after them, and I do regret not being able to save the human soldiers, but Charles Xavier and his School is no threat. They are working for us, not against us."
The Lawyer moved to the Judge, as he went to his seat. "No further questions."
The Judge motioned for Steve to return to his seat. "Mr. Fitzgerald, you can now ask Mr. Stark any questions about his involvement at the school." And he motioned for Tony to Take Steve's place on the stand.
