You can't seriously be using Nightwing OYL as justifying anything. Or do you advocate that Dick's characterization was sound, when he was wishing that Jason had died in the exploding building at the end of Under the Hood?
Neither Jason nor any other character has commented on the unleashing of Amazo as being a murder attempt. And it's pretty clear that Jason absolutely didn't want Bruce to die at this point. There was nothing serious about that 'attempt'.
