Some perfectly legal Young Justice
As much as I love YJ, there is an obvious barrier to me posting it here. Luckily, there's a handful of pages from Young Justice #22, by Todd's Dezago and Nauck.

The setup: This issue is pretty much filler after a major story arc (Sins of Youth), guesting various writers and artists. Superboy lost his powers, and is getting by on gadgets from Cadamus. While other characters are off learning lessons with their older counterparts, Bart and Secret decide to help out...

I did see that; he doesn't mention anything about the nebulous middle of the spectrum between "a panel or a page" and "over half" (which wasn't really an accurate description of the X-Factor post). There's just no way to know how his personal judgment will work for in-between cases.

I'm sorry, I thought when you wrote that Peter David "didn't seem to have any official position," you meant he'd expressed no position except the words you quoted. Apparently your point was that his earlier, more specific words didn't spell out exactly what he'd consider fair use.

Of course, fair use is a deliberately misty part of copyright law that depends a lot on context, so David couldn't spell out helpful guidelines for us, especially in regard to work owned by other copyright-holders. All that's already been said.
