If you plan to play a Death Eater, please read this first!
The mods here feel like free Death Eaters who still believe in Voldemort's ways, and who are killers without consequence, only slow down the progress of a game. Sending Aurors out to chase down a Death Eater that will never be caught because a player doesn't want their DE sent to Azkaban, is absurd to us. So, if you're going to play a DE who has committed a crime they would spend the rest of their lives in Azkaban for, you are welcome to do so, but be aware that they will not be given a journal and the only interaction they will be given will be with those who work at Azkaban.
Yes, you would be allowed to have them try to escape, and maybe even succeed. However, they would not be free for long. Your DE would either be caught and put back, or would be given the Dementor's Kiss. It makes more sense than having a DE who's going around causing trouble, but never getting caught.
If you plan to play a DE who would be able to be reformed and has only committed minor crimes, there is a rehabilitation program in the game. It's a sort of halfway house for DE and, once your DE proves himself/herself, he/she would be allowed to go back home. This also applies if the character was never caught with an unforgivable crime, or was never convicted. Just remember that if that character were to commit another unforgivable, they would be thrown right back into Azkaban.
If you're dead set on having your DE go on murdering sprees, think before you do it. In order for your character not to get chucked into Azkaban or killed, he or she would have to implement a plan to cover his or her tracks. This includes not putting the Dark Mark everywhere and not bragging about it in a journal.
NOTE: Because of the below comment, we felt we ought to add this. We understand that people would like to play Death Eaters. We never said that they could not be played as we do welcome conflict. We do not, however, welcome conflict without resolution. That being said, if you have a DE who has not committed a crime/has not been caught committing crime, or is part of the rehabilitation program, or even still in Azkaban, we welcome them. However, Azkaban prisoners will not be given a journal, and therefore would likely not be very playable. And, if your "innocent" or "rehabilitated" DE gets caught committing a crime, be prepared to have them chucked into Azkaban. And, if they're already there, they wouldn't be very playable. We hope this clarification helps.
