Ooh, yes, good point! (I should *so* not post comments to thinky meta late at night, lol).
IP is so important online - but the definitions are as vague as the laws, so far. And it's all applied very inconsistently, as you point out. Why aren't all authors treated the same? Why are hugely "derivative" authors idolized, while hugely original fanficcers have to hide underground? Why is fan-art okay to charge money for and fan-fic not, and fan-vids maybe-we're-not-sure?
Maybe this strange new world of inconsistency and contradiction and just plain makes-no-sense is part of the reason for wank. Feelings can explode in an atmosphere of uncertainty.
