New Marriage Laws TodayEarly this morning, James S. Potter, spokesman for Minister Percy Weasley, announced that after a quick and swift vote by the Wizengamot, the much needed reform for the marriage decrees was singed into law. The law was one of the main goals of the administration, trying to bring back a system of law and order in our society. The decrees were promulgated by the Home Office, headed by Secretary of State Hermione Granger, before receiving the approval from the Minister and being submitted to the Wizengamot for a final decision. Anyone having submitted requests for annulments of marriages contracted during the Riddle administration would receive confirmation of the annulment today or tomorrow. Anyone else requesting an annulment will be about to receive a speedy response. The full text of the laws is hereby reported: Article189 of the Marriage Decrees: There will be two authorized spells that will allow wizards and witches to enter into the legal and magical bond of marriage. Permanent Marriage Spell - this spell will make the union indisolluble. No spell of divorce will be allowed. Only death or annulment as specified in Article 190 will be allowed. Dissoluble Marriage Spell - unions entered into with this spells can be annuled under Article 190 or dissolved under Article 191 Article 190 of the Marriage Decrees: Annulment spell will be allowed if the marriage is entered into by force, fraud, or if either party is incapable to consent either because of one or more of the parties is not of legal age or because of mental incapacitation. Article 191 of the Marriage Decrees: Divorce spell will be allowed a. For cause - Adultery: Clear and Convincing evidence must be provided Abandonment: separation must last at least a year Cruel and Inhuman Treatment: three clear and distinct events must be proven Constructive Abandonment: sexual relationship must cease for at least a year b. If mutually agreed upon. Article 192 of the Marriage Decrees: Marriages contracted during the Riddle administration can be annul with the request by one of the parties. No proof of fault must be shown. Article 39 of the Civil Registry Decrees: Children of marriages dissolved under the Riddle administration will be allowed to use the father's last name only after the parents get married again. |
